Lawsuit filed by the Doc group against Health Reform Law
In a recent move, the association of American Physicians and Surgeons (AAPS), a group of conservative activist doctors, became the first physician group to file a lawsuit aimed at overturning the new healthcare reform law. With the president's ink barely dry on the health care overhaul's final fixes, a group of nearly 5,000 American physicians supported the move to stop the new law dead in its tracks.
Supporters of the law call it as simple tax meant to shore up coverage nationwide while the AAPS says that the mandate is an "Unprecedented overreach" calling it as unconstitutional grab that rewards insurance companies and allows the federal government to seize private property in violation of the 5th Amendment.
Orient, an internist based in Tuscon said, "Insurers will have millions of new, unwilling customers that they wouldn't have gotten. They're counting on getting all this new money." Orient says she hopes more groups will join her suit and predicts a shortage of doctors as the medical community adjusts to the new law.
The Arizona based medical coalition filed suit on March 26, arguing that congressional reforms illegally coerce individuals into buying insurance from private companies. On its Web site, the AAPS touts itself as one of the few doctors groups that did not "sell out" to have "seat at the table" in Washington.
The new healthcare reform law requires that most individuals have health insurance by 2014, or face penalties. Virginia and Idaho have already enacted laws exempting their residents from health insurance mandates. There are movements in at least 39 other, particularly those with Republican legislatures or Governors, requesting to enact similar legislation.
